PLEASE READ THESE LEGAL NOTICES CAREFULLY BEFORE USING THE REGISTRAT-MAPI WEBSITE ("Site"). BY USING THIS SITE, YOU ACKNOWLEDGE YOUR AGREEMENT AND ACCEPTANCE OF THESE LEGAL NOTICES. IF YOU DO NOT AGREE TO ALL OF THE TERMS WITHIN THESE LEGAL NOTICES, DO NOT USE THE SITE.

REGISTRAT-MAPI reserves the right, at its sole discretion, to change these legal notices from time to time, and your accessing the Site will be deemed to be your acceptance of and agreement to any revised notices. Because your continued use of the Site will mean you accept those changes, it is your responsibility to review the legal notices periodically.

REGISTRAT-MAPI staff may include physicians and other medical practitioners including without limitation pharmacists, nutritionists, nurses, nurse practitioners, and other health care professionals. These professionals are available solely to assist you in general research. They will not engage in any conduct via the Site that involves the practice of medicine.
    4. The Site, or the sites linked to through the Site, may contain health or medical related materials that you find sexually explicit or otherwise offensive. REGISTRAT-MAPI and Licensors and Suppliers have no control and no responsibility for such materials. You are responsible for compliance with the laws of your local jurisdiction with respect to accessing, importing, exporting, or re-exporting the Contents of the Site whether inside or outside the United States of America (“USA”).

  2. SERVICES.
    1. REGISTRAT-MAPI conducts clinical research, providing strategic study design and management, implementation, clinical data management, programming, and statistical support services to providers, manufacturers, and medical societies within the healthcare industry. REGISTRAT-MAPI is providing information via the Internet as a complimentary service to you, and makes no representations about the suitability or content of information or services provided on the Site or linked to from the Site. Any opinion expressed on a site linked to from the Site is the opinion of the author and not necessarily of REGISTRAT-MAPI.
    2. REGISTRAT-MAPI may alter features and specifications of its services at any time without notice.
  3. HOW YOU MAY USE OUR MATERIALS.
    1. The Content of this Site is protected by copyright under both USA and foreign laws. You may download, use, and copy the materials found on the Site for your personal, noncommercial use only, provided that all copies that you make of the material must bear any copyright ("Copyright © 2010 by REGISTRAT-MAPI. All rights reserved."), trademark, or other proprietary notice located on the Site which pertain to the material being copied. Except as authorized in this paragraph, you are not being granted a license under any copyright, trademark, patent, or other intellectual property right in the material or the services, processes, or technology described therein. All such rights are retained by REGISTRAT-MAPI and/or any third party owner of such rights.
    2. You may not create framed links to the Site without express written permission from REGISTRAT-MAPI.
    3. You may not sell or modify the Content or reproduce, display, publicly perform, distribute, or otherwise use the Content in any way for any public or commercial purpose. The use of the Content on any other website or in a networked computer environment for any purpose is prohibited. None of the Content, including any software, may be reverse engineered, disassembled, decompiled, reproduced, transcribed, stored in a retrieval system, translated into any language or computer language, retransmitted in any form or by any means, resold, or redistributed without the prior written consent of REGISTRAT-MAPI, except as described in 3(a).
    4. As a condition of your use of the REGISTRAT-MAPI Site and services, you will not use the REGISTRAT-MAPI Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the REGISTRAT-MAPI Site in any manner which could damage, disable, overburden, or impair any REGISTRAT-MAPI Site (or the network(s) connected to any REGISTRAT-MAPI Site) or interfere with any other party's use and enjoyment of any REGISTRAT-MAPI Site. You may not attempt to gain unauthorized access to any REGISTRAT-MAPI Site, other accounts, computer systems or networks connected to any REGISTRAT-MAPI Site, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the REGISTRAT-MAPI Site. If you breach any of these terms, your authorization to use this Site automatically terminates and you must immediately destroy any downloaded or printed materials. REGISTRAT-MAPI also reserves the right to terminate your authorization to use any services at the Site and to delete any one or more of your related accounts immediately and at any time if you breach or threaten to breach any of these terms. If you are younger than 13 years of age, you are forbidden from using this Site without direct written parental consent.
    5. With respect to information obtained from REGISTRAT-MAPI's Licensors and Suppliers, you are solely responsible for compliance with any copyright, trademark, and other proprietary rights and restrictions.
  4. SOFTWARE AND CONTENT AVAILABLE THROUGH THE SITE.
    1. All Content and software (if any) that is made available to view and/or download in connection with the Site, excluding content and/or software that may be made available by end-users, ("Software") is owned by and is the copyrighted work of REGISTRAT-MAPI and/or its suppliers and is protected by copyright laws and international treaty provisions. Your use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software ("License Agreement").
    2. You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms.
    3. For any Software not accompanied by a license agreement, REGISTRAT-MAPI hereby grants to you, the user, a revocable personal, non-transferable license to use the Software for viewing and otherwise using the Site in accordance with these terms of use, and for no other purpose provided that you keep intact all copyright and other proprietary notices. Any reproduction or redistribution of the content and/or Software is expressly prohibited by law, and may result in severe civil and criminal penalties.
    4. Violators will be prosecuted to the maximum extent possible. WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE CONTENT OR SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED. You acknowledge that the Software, and any accompanying documentation and/or technical information, may be subject to applicable export control laws and regulations of the USA. If applicable, you agree not to export or re-export the Software, directly or indirectly, to any countries that are subject to USA export restrictions.
  5. USE OF OUR MARKS.
    1. The REGISTRAT-MAPI name and logo and all related product and service names, design marks, and slogans are the trademarks or service marks of REGISTRAT-MAPI. You are not authorized to use any REGISTRAT-MAPI name or mark in any advertising, publicity, or any other commercial manner without the prior written consent of REGISTRAT-MAPI.
  6. LINKS TO OTHER SITES.
    1. All product and service marks contained herein that are not REGISTRAT-MAPI marks are the trademarks of their respective owners. References that we make to any names, marks, products, or services of third parties or hypertext links to third party sites or information do not necessarily constitute or imply our endorsement, sponsorship, or recommendation of the third party, information, product, or service.
    2. REGISTRAT-MAPI is not responsible for the content of any site linked to or from the Site or for any healthcare provider whose name, address, or telephone number is listed on a site linked to from the Site. Linking to any other site or contacting any healthcare provider whose contact information is found on a linked site is entirely at your own risk. While REGISTRAT-MAPI may provide links on this Site to other sites, the inclusion of such links is solely for your convenience and should not be interpreted as an endorsement of the owner/sponsor of the site, the content of the site, or the healthcare provider whose contact information is provided therein. REGISTRAT-MAPI does not exert any editorial or other control over other sites.
    3. REGISTRAT-MAPI disclaims all warranties, express and implied, as to the accuracy, validity, and legality of any materials or information contained in sites linked to from the Site.
  7. CONTENT AND LIABILITY DISCLAIMER.
    1. In no event shall REGISTRAT-MAPI and/or Licensors and Suppliers be liable for any special, indirect, or consequential damages, or any damages whatsoever resulting from loss of use, data, or profits from the inability to use data, whether in an action in contract, negligence, or other tortuous action, arising out of or in connection with the use of the Site or failure or inability to use or access the Site. If REGISTRAT-MAPI's disclaimer of warranties or limitation of liability set forth herein is held unenforceable or inapplicable, you agree that your sole remedy is to stop using the Site.
    2. REGISTRAT-MAPI may make improvements and/or changes in the products, services, and/or programs described in these materials at any time without notice. The materials on the Site are provided to you free of charge, "AS IS/AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. REGISTRAT-MAPI DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIALS ON ANY REGISTRAT-MAPI SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY REGISTRAT-MAPI SITE OR THE SERVERS THAT MAKE SUCH MATERIALS AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
    3. REGISTRAT-MAPI does not make any warranty that the Content contained on the Site satisfies government regulations requiring disclosure of information on prescription drug or other products.
  8. JURISDICTION.
    1. These legal notices are governed by the internal substantive laws of the Commonwealth of Kentucky, USA. You expressly agree that sole and exclusive jurisdiction for any claim related to these legal notices and the REGISTRAT-MAPI Site that involve REGISTRAT-MAPI affiliated entites shall be in the appropriate state or federal court located in the Commonwealth of Kentucky, USA.
    2. The Site is operated from a site in the Commonwealth of Kentucky, USA. REGISTRAT-MAPI makes no representation that materials found at the Site are appropriate or available for use in other locations. If you access the Site from other locations, you are responsible for compliance with local laws. Except as expressly provided in a particular legal notice on the Site, these terms and conditions, along with the Privacy Statement, and any amendments thereof, constitute the complete agreement between you and REGISTRAT-MAPI with respect to use of the Site.

COPYRIGHT INFRINGEMENT CLAIMS

If you believe that any portion of the material contained in this site infringes your copyright, notify REGISTRAT-MAPI of your claim in accordance with the following procedure. REGISTRAT-MAPI will take appropriate action as required by the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512(c)(3).

To be effective, the Notification must be in writing and contain the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
  4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of the written Notification containing the information outlined above, REGISTRAT-MAPI will:

  1. Remove or disable access to the material that is alleged to be infringing;
  2. Forward the written notification to such alleged infringer ("Subscriber");
  3. Take reasonable steps to promptly notify the Subscriber that it has removed or disabled access to the material.

A Counter Notification will be effective if in writing, provided to the Designated Agent, and including substantially the following:

  1. A physical or electronic signature of the Subscriber;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that the Subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
  4. The Subscriber's name, address, and telephone number, and a statement that the Subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located or, if the Subscriber's address is outside of the USA, for any judicial district in which REGISTRAT-MAPI may be found, and that the Subscriber will accept service of process from the person who provided notification or an agent of such person.

Upon receipt of a Counter Notification containing the information outlined above, REGISTRAT-MAPI will:

  1. Promptly provide the complaining party with a copy of the Counter Notification;
  2. Inform the complaining party that it will replace the removed material or cease disabling access to it within ten (10) business days;
  3. Replace the removed material or cease disabling access to the material within ten (10) to fourteen (14) business days following receipt of the Counter Notification, provided REGISTRAT's Designated Agent has not received notice from the complaining party that an action has been filed seeking a court order to restrain Subscriber from engaging in infringing activity relating to the material on REGISTRAT-MAPI's network or system.
